The purpose of this contract is to define the general conditions of use and sale of the mobile application "Chari.ma" hereinafter referred to as "the mobile application" or "the service".
The “Chari.ma” mobile application is owned by the company Chari.ma, a public limited company incorporated under Moroccan law with a share capital of MAD 300,000, located at the Ouled Saleh industrial zone; Bouskoura CP 27182 Casablanca; RC 405363; IF 25287374; Patent 55890063; CNSS 1009705; ICE 002085583000087.
This contract includes all the agreements concluded between the mobile application and the end customers hereinafter referred to as "users". Chari.ma invites all users to read and become aware of these CGU. As the CGU/CGV are liable to be modified or changed, the mobile application undertakes to inform users of the modifications thereof.
When installing the application, the user accepts all of the CGU/CGV by checking the box I have read and I accept the general conditions of sale and use.
In case of reservation on a clause of the CGU/CGV, please do not use the mobile application. In this case, we recommend that you uninstall the application.
The application also informs users that even partial use of any service constitutes proof of acceptance of the CGU/CGV.
The user can at any time consult the CGU / CGV from the application by going to the "My Account" tab and then clicking on CGU / CGV.
Chari.ma is an online purchasing center, providing grocery stores and convenience stores with consumer products at competitive prices. Chari.ma provides free delivery of products purchased within 2 days from the day of the order validation.
User: refers to any natural or legal person who owns a convenience store who has completed his registration on the mobile application, who has been verified as to his identity and the location of his business. The registration procedure is described in article 5 of this contract.
Prospect: Any natural or legal person who has expressed a desire to use the application service without, however, completing the registration steps.
Order: Any order validated by a registered user.
Product: refers to all material things that can be sold and appropriated for sale on the Chari.ma application
End consumer: Refers to the natural or legal persons likely to consume the products purchased by users.
Registration is done in three steps:
Step 1: The prospect downloads the mobile application and fills out the registration form, at this step only the name and phone number are collected.
Step 2: The Chari.ma call center calls the prospect to verify their information and collect additional information: The geolocation of their store and a photo of the storefront.
Step 3: The user receives access credentials for his user account,
At the first connection with these identifiers, the user is referred to the CGU / CGV page that he expressly accepts by checking the box "I have read and I accept the CGU/CGV / CGU/CGV". Then, the user is invited to change their password in order to ensure the security of their data.
Any Order can only be made when the User registers on the application. The User, when logged into his account, can add Products to his basket. He can then access the summary of his basket in order to confirm the Products he wishes to order and their quantity and place his Order by pressing the "Confirm my order" button. The finalization of the Order implies acceptance of the prices of the Products sold, as well as the terms and delivery times indicated on the application. Once the order is placed, the user receives a call from the Chari.ma call center. This call will summarize the order as well as relevant delivery information. Placing an Order constitutes the conclusion of a distance selling contract between the Company and the Customer.
The Products subject to the CGU / CGV are those which appear on the application and which are sold and shipped directly by the Company. The Products are described on the corresponding page within the application and mention is made of all their essential characteristics. The sale is made within the limits of the Company's available stocks. The latter cannot be held responsible for out of stock or the inability to sell a Product whose stock is non-existent.
When a registered User wishes to acquire a Product sold by the Company, the price indicated on the Product page corresponds to the price in dirhams, all taxes included (TTC), excluding shipping costs and takes into account the applicable reductions in force on the day. of the order. Under no circumstances may a User require the application of reductions no longer in effect on the day of the order.
Unless otherwise stipulated, payment for orders is made in cash at the time of delivery. The accepted payment methods are: Cash, Checks and bank transfer.
The delivery of the ordered products is made at the expense of Chari.ma free of charge within a period not exceeding 48 hours after the validation of the order or on the date chosen by the customer if this is greater than 48 hours.
The transfer of ownership of the products takes place at the time of delivery and after receipt of payment.
The verification of the physical integrity of the delivered products as well as the quantity of these is the responsibility of the user who by signing the delivery note accepts the products as they are.
Chari.ma ne peut être tenu responsable pour toute dégradation de produit, nuisance à la santé du consommateur final des produits achetés depuis l’application vu que la propriété des produits a été transférée à l'utilisateur qui en devient responsable ( Entreposage, stockage et veille sur les dates de péremption).
Any complaint must be the subject of a written letter sent by post within a period not exceeding 48 hours from receipt of the products at the following address: “Chari.ma, Zone Industrielle Ouled Saleh, Bouskoura CP 27182 Casablanca. ”
The Company replaces or reimburses the product as soon as possible and at its expense, subject to its availability in stock.
Paragraph 12.a: Data collected by Chari.ma
The data collected by Chari.ma has the sole purpose of identifying users and monitoring the proper functioning of payment and delivery services.
The data collected are as follows: Last name, First name, Telephone number, geolocation of the store and the photo of the store front.
The collection of first and last names are used by our sales department to create user files.
The telephone number constitutes a key data for the exchange with the users.
The sole purpose of collecting geolocation is to specify the delivery address of the products.
Storefront photos are a reliable way for the company to ensure that the user is a local business and not an end consumer.
Paragraph 12.b: Data processing
Data processing is done semi-automatically.
The collection of first and last names is automated from the registration form
Geolocation and storefront photos are collected after consent sent to the company during the registration call sent by the Chari.ma call center
Paragraph 12.c: Data sharing
As the data is used strictly internally, no data sharing takes place.
Paragraph 12.d: Right to access and modify data
In accordance with Law No. 09-08 relating to the protection of individuals with regard to the processing of personal data, users have at any time the right to query, access, rectification, modification and opposition to all of their personal data by writing, by mail and justifying their identities, to our main contact in paragraph 12.e.

The Company ensures an appropriate level of security proportional to the risks incurred as well as their probability, In accordance with Law No. 09-08 on the protection of individuals with regard to the processing of personal data. br>
However, these measures in no way constitute a guarantee and do not commit the Company to an obligation of result concerning data security.
Chari.ma is the owner of the intellectual property rights or holds the rights of use on all the elements accessible on the mobile application, in particular the texts, images, graphics, logo, sounds, software ...
Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the application, whatever the means or process used, is prohibited without the prior written consent of: Chari.ma
Any unauthorized use of the application or any of the elements it contains will be considered as constituting an infringement and prosecuted in accordance with the provisions of articles of Moroccan law.
These CGU/CGV are subject to Moroccan law.
Any dispute concerning the application or interpretation of these CGU/CGV will be submitted to the competent court in Casablanca.
